Pedestrian Medical Expenses

Oregon PIP statutes require coverage for pedestrians hit by a car, but they also say that other sources of payment come first. The pedestrian's own PIP policy is primary, the pedestrian's health insurance is next, and the PIP on the car that hit the pedestrian is third. The statute setting out which insurer is primary, secondary, and tertiary, is not a model of clarity, and occasionally adjusters want to fight about who has to pay the pedestrian medical expenses. However, with three layers available, there is usually an insurer who will have pedestrian medical coverage.
